Terms of Service

By accessing or using Headshotr ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree to any of these terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Headshotr.

Headshotr is a service that uses artificial intelligence to transform selfies into professional portraits (headshots). The service processes your photos through AI models to generate professional-looking images.

You must be at least 18 years old and have legal capacity to enter into this agreement. By using the Service, you represent and warrant that you meet these requirements.

• You are responsible for maintaining the security of your account and any activity that occurs under it.
• You must provide truthful and up-to-date information.
• Each account is personal and non-transferable.
• You must notify us immediately if you suspect unauthorized access to your account.

By uploading photos to Headshotr, you represent and warrant that:

• You own the photos or have express authorization from the photographed person.
• You have consent from any person appearing in the photos.
• The photos do not depict minors.
• The photos do not contain illegal, offensive, or rights-infringing content.

By uploading photos, you grant us a limited, non-exclusive, temporary license to process said photos exclusively for the purpose of generating your portraits. This license expires when we delete your photos according to our retention policy.

Portraits generated by Headshotr are created using artificial intelligence. We grant you a perpetual, worldwide license for any lawful purpose over images generated from your photos.

AI-generated images may have uncertain copyright status under current law. We do not guarantee copyright protection over generated portraits.

We are not responsible for how you use generated images. You are responsible for ensuring their use complies with applicable law.

You may not use the Service to:

• Upload photos of people without their consent.
• Upload photos of minors.
• Generate illegal, fraudulent, defamatory, or harmful content.
• Create images for identity impersonation or deception.
• Attempt to access, copy, or reverse-engineer the AI models or underlying technology.
• Overload, interfere with, or abuse the Service infrastructure.

Headshotr complies with United States federal law and will report any child sexual abuse material (CSAM) to NCMEC.

Some aspects of the Service require a paid subscription.

• You will be billed according to the plan you choose, at the beginning of each billing period.
• Subscriptions automatically renew at the end of each period.
• You may cancel your subscription at any time. Cancellation is effective at the end of the current billing period.
• Payments are non-refundable, except as required by applicable law. Unused generations do not carry over between periods.

Payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service.

We strive to keep the Service available, but we do not guarantee uninterrupted operation. Interruptions may occur due to maintenance, updates, or causes beyond our control.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without prior notice.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee the quality, accuracy, or suitability of generated portraits.

In no event shall our total liability exceed the amount you have paid for the Service during the 12 months preceding the event giving rise to the claim.

We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or reputation.

You agree to indemnify and hold harmless Headshotr and its directors, employees, and providers from any claims, damages, or expenses arising from: (a) your use of the Service, (b) content you upload, (c) your breach of these Terms, or (d) your violation of third-party rights.

We may suspend or terminate your account if you violate these Terms or if we determine that your use of the Service is harmful to other users or to us. We will notify you when reasonably possible.

Upon account termination, we will delete your personal data according to our Privacy Policy. Data we must retain due to legal obligations will be kept securely for the required period.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in competent courts.

We may modify these Terms at any time. We will post changes on this page with a new update date. Continued use of the Service after changes constitutes your acceptance of the updated Terms. For material changes, we will notify you by email.
